Article 12: Real Estate Agent or Developer? – Pros, Cons and Risks

When buying property in Turkey, most foreign buyers work with either a real estate agent or a developer’s sales team – or both. Understanding what each one does and how the process works makes the experience smoother and the outcome better.

12a. The real estate agent

A licensed Turkish estate agent is an intermediary between buyer and seller. Their income depends on the deal closing – not on whether the deal is right for you. A good agent provides:

  • Access to a wide range of listings across multiple sellers
  • Local market knowledge on areas, prices, and demand patterns
  • Language bridge between you and Turkish-speaking sellers
  • Price negotiation on your behalf

Points to verify with any agent:

  • Shows the same property at different prices to different buyers
  • Uses fake or heavily edited listing photos
  • Operates without a valid licence – since January 2026 all listings must carry EIDS verification
  • Charges above the legal maximum commission rate (3.57% from a single party)
  • Creates artificial urgency to pressure quick decisions

12b. The developer’s sales team

When buying directly from a construction company, you deal with their in-house sales team. Their role is to present the developer’s properties. For legal review and contract protection, that is where your own lawyer comes in. Buying direct can have advantages – no agent commission, instalment plans, VAT exemption – but the risks are significant:

  • The contract is drafted entirely in the developer’s favour
  • Delivery timelines and penalty clauses are rarely in the standard contract
  • The sales team will not flag problems with planning permission or financial difficulties
  • Show apartments are always the best unit – your actual unit may differ

12c. How to verify a real estate agent

Since January 2022, Turkish estate agents must hold a mandatory licence (Yetki Belgesi) issued by the Ministry of Trade. Ask to see it. Since January 2026, all listings must carry EIDS verification. Reliable signals: works with a dedicated property lawyer, provides written commission agreement before showing properties, does not apply time pressure.

12d. Eids verification — The new baseline check

Since January 2026, all property listings in Turkey must carry EIDS (Electronic Advertisement Verification System) certification. An EIDS number on a listing means the property details have been verified against Land Registry records — The advertised address, plot number, and basic legal status have been confirmed. A listing without an EIDS number is unverified and should be treated with caution. Check the EIDS number on any listing you are seriously considering at the Emlak Bilgi Sistemi portal. This does not replace legal due diligence — it is a baseline check, not a legal clearance.

12e. How to verify a developer’s track record

Before signing anything with a construction company, run these checks: ask for the names of two or three previous completed projects in Turkey. Visit one if possible — speak to residents about delivery timeline, build quality, and how the developer handled punch list items after handover. Search the company name in Turkish court records (UYAP) via a lawyer — any significant litigation history involving buyers will appear. Check whether the company is a member of the Turkish Contractors Association (İnşaat Müteahhitleri Federasyonu). A developer who has built one project and is now selling their second deserves more scrutiny than one with ten completed buildings.

Since 2020, Turkish estate agents are required to hold a licence (emlak müşavirliği yetki belgesi) issued by the relevant Chamber of Commerce. Ask the agent directly for their licence number and verify it. Since January 2026, all listings must carry EIDS verification — an unlicensed agent cannot obtain EIDS numbers for their listings. An agent operating without a licence has no professional accountability and no regulatory body you can complain to. Dealing with unlicensed agents significantly increases your risk exposure.

Quora: “The developer’s sales team were very helpful and professional. Do I still need my own lawyer?”

Yes. Professionalism and legal obligation are different things. A developer’s sales team can be genuinely helpful, knowledgeable, and friendly — and still represent the developer’s interests, not yours. Their job is to close the sale on terms that work for the developer. Your lawyer’s job is to ensure the terms work for you. These interests diverge most sharply at exactly the moment that matters most: contract review. A clause that costs you 10,000 EUR is not going to be flagged by the developer’s team. It will be flagged by your lawyer.
