Article 27: Marriage to a Turkish Citizen – Requirements, Risks, Fake Marriage Traps

27a. The basic truth

Marrying a Turkish citizen does not automatically grant Turkish citizenship. Foreign nationals who have been married to a Turkish citizen for at least three years and whose marriage is ongoing can apply for citizenship. However, making an application does not guarantee that citizenship will be granted – The final decision rests entirely with the state.

27b. Legal requirements

  • Duration: At least 3 years of marriage, with the marriage still ongoing
  • Cohabitation: Must be genuinely living together except in cases of force majeure
  • Marriage registration: Must be registered in Turkish civil records
  • Criminal record: No situation constituting a security obstacle
  • Conduct: No activity incompatible with the marital union
  • Marriage abroad: A marriage conducted outside Turkey does not qualify – The marriage must be registered in Turkey

27c. The real process – The law says 3 years, life says otherwise

Although the law states 3 years, the reality can be very different. There are people who have been married for 7 years and have still not received citizenship. This is entirely a matter of the states discretion – The state can reject, suspend or simply never conclude an application.

If you divorce after submitting the application: The application lapses. Citizenship is not granted.

If you divorce before 3 years: The right to apply does not arise at all.

How long does the process take: Officially 4-6 months – but in practice it can take considerably longer.

27d. Application process

Required documents:

  • Biometric photograph, passport, civil registration document, valid residence permit, Turkish spouses civil registration record, service fee receipt

Where to apply:

  • If you are in Turkey: the Provincial Civil Registration and Citizenship Directorate where you are registered
  • If you are abroad: this right does not apply – The marriage must be registered in Turkey

Interview:

The Citizenship Review and Investigation Commission interviews the applicant and their Turkish citizen spouse both separately and together. The sincerity of the marriage is questioned. The address of the shared home, daily routines, shared memories and family members are cross-checked.

27e. Police control – when does it come, when does it not?

Police may check the marriage – or they may never come at all. You cannot know when it will happen.

Situations that can trigger a check:

  • The registrar notices an anomaly during the ceremony and reports it to the police
  • Neighbours report to the police
  • Frequent and high-value bank transfers between the married couple or their relatives – this is one of the most important signals taken into account by the police

Situations that do not trigger a check:

Couples believed to be a genuine family may not even receive a home visit. A problem-free and genuine marriage generally also proceeds without problems in the citizenship process.

27f. Property regime – do not take risks without knowing

Everyone who marries in Turkey – Turkish or foreign – is subject to the same laws. The legal property regime in Turkey is the participation in acquired property regime. The rule is as follows:

  • Property acquired BEFORE marriage: belongs solely to you. Your spouse has no rights over it – not even in the event of divorce.
  • Property acquired DURING marriage: is jointly owned. Any house, car or other asset purchased after marriage gives your spouse a legal share.

Example: If you own 5 properties before marriage, they are entirely yours. If you buy one more property after marriage, that property is jointly owned.

Protection: Before marriage, arrange a separation of property agreement through a notary. This agreement is legally valid and protects you.

27g. Children

A child born in Turkey automatically becomes a Turkish citizen. Having one foreign parent does not affect this right.

27h. Fake marriage traps

The foreigner becomes the victim: I will arrange your marriage to a Turkish citizen, citizenship guaranteed. Money is taken, fake documents are prepared, the fraudster disappears.

The Turkish spouse becomes the victim: After the wedding, the foreign spouse pressures the Turkish spouse to buy me a house, buy me a car, give me money. Once all assets have been transferred, they leave. Cases like this have been witnessed first hand.

How to protect yourself:

  • Do not rush into marriage – take at least 1 year to get to know the person
  • Arrange a separation of property agreement through a notary before marriage
  • Get legal support from an independent lawyer
  • Get a second opinion from someone you trust
  • Be careful about bank transfers – irregular money flows are taken seriously by the police
